A Google Web Receiver is any piece of hardware that contains Google Cast technology, including but not limited to the Chromecast device.

2.2   You agree that Google and/or third parties own all legal right, title and interest in and to the SDK, including any Intellectual Property Rights that subsist in the SDK. "Intellectual Property Rights" means any and all rights under patent law, copyright law, trade secret law, trademark law, and any and all other proprietary rights. Google reserves all rights not expressly granted to you.

2.3   You agree that the form and nature of the SDK that Google provides may change without prior notice to you and that future versions of the SDK may be incompatible with applications developed on previous versions of the SDK. You agree that Google may stop (permanently or temporarily) providing the SDK, features within the SDK, or support for the SDK to you or to users generally at Google's sole discretion, without prior notice to you. For the sake of clarity, and without limiting the foregoing, Google does not commit to maintaining every version of its SDK -- please be sure to keep your application updated to the latest SDK.

2.4   Your application may be de-registered by Google with or without notice at Google's sole discretion including, but not limited to, for violation of these Terms. If you have any questions or concerns regarding such a de-registration, you may contact us at Cast Support.

3.   Developer policies
3.1   Any application using the Google Cast SDK may not circumvent, compromise or otherwise adversely impact any access protections of a Google Cast Receiver, including but not limited to the requirement that only registered applications may utilize the Google Cast SDK.

3.2   You may not use the Google Cast SDK, either directly or by using the contents of the Google Cast SDK, to develop a standalone technology and/or to block or otherwise adversely impact any functionality of any Google Cast Receiver. For example, you may not build functionality equivalent to the APIs provided by the Google Cast SDK. You further agree that you will not create any exploits of any Google Cast Receiver, such as rooting a device.

3.3   You must register your application through the developer console. You may not circumvent that registration process, either for yourself or others.

3.4   Your application (including the sender and receiver elements) utilizing the Google Cast SDK:

3.4.1   must not use the Google Cast SDK to initiate any application on the Google Web Receiver other than the application from which the user is trying to cast content, and you must take appropriate steps to ensure that your application cannot be invoked to launch content for which you are not responsible;
3.4.2   must not create a means by which applications can cast content to a Cast device without incorporating the Google Cast SDK into their applications;
3.4.3   must not encourage users to utilize Chromecast or any other Google Web Receiver in a way that violates our Terms of Service or usage warnings (e.g., for high-risk activities) ;
3.4.4   must include protections against screen burn-in;
3.4.5   must be designed to work on all Google Cast Receivers, and shall not be blocked or otherwise prevented from working on any particular Google Cast Receiver;
3.4.6   must use the Google Cast SDK’s Play Control APIs for any features that control the playback of content being cast (e.g., pause button, fast-forward button). “Play control APIs” are the APIs that permit your application to communicate with a Google Web Receiver so that the user can control the content being cast;
3.4.7   must not log any personally identifiable information of any user in the console logs of the user’s Google Cast Receiver;
3.4.8   must not automatically cast content. Content should only be cast in response to a user request to cast that content;
3.4.9   must reasonably comply with the Google Cast Design Checklist; and
3.4.10   must not persistently store, or attempt to persistently store, any information on the Google Web Receiver itself.
3.5   Google makes available a means by which you can register Google Cast receivers for development purposes. In the event you request that Google Cast receivers be registered, you agree that any such registered Google Cast receivers will only be used for development purposes. You agree not to circumvent the registration process or make registered devices available to third parties without Google’s express written permission. You agree that Google may associate the serial number of a registered device with your e-mail address or other information you provide to Google.

4.   Content Policy
4.1   You must comply with the Content Policies listed in the Google Play Developer Program Policies.

5.   Icons and Trademarks
5.1   Cast button

5.1.1   Your application must use the cast button available in the Get Started guide as the button users press to initiate a Cast session.

5.1.2   The cast button must be at the top level, meaning that it cannot appear in a drop-down menu.

5.1.3   The cast button must appear on all pages that show content that can be sent to a Google Cast Receiver.

5.2   Brand features

5.2.1   "Brand Features" means trade names, trademarks, service marks, logos, domain names, and/or other distinctive brand features that you either submit to Google or of which you approve Google’s use in writing.

5.2.2   You shall own all right, title and interest, including without limitation all intellectual property rights, relating to your Brand Features. Except to the limited extent expressly provided below, You do not grant Google any right, title or interest (including, without limitation, any implied license) in or to any of Your Brand Features.

5.2.3   Subject to these Terms, you grant to Google and its affiliates a limited, non-exclusive, worldwide, royalty-free license to display your Brand Features for purposes of markeßting the interoperability of your application with Google Cast. Google and its affiliates may include your Brand Features: (i) on any Google-owned online or mobile properties; (ii) on Google or non-Google properties promoting Chromecast or other Google Cast receivers, including but not limited to product listings or promotions and offline marketing; (iii) in presentations; and (iv) in lists of interoperable applications which appear either online or on mobile devices (which includes, without limitation, lists posted on Google websites). If your application at any point ceases being Google Cast-compatible, Google will cease use of your Brand Features for such marketing purposes in connection with that application.

5.3   Google grants you a limited, non-exclusive, worldwide, royalty-free license to use the "Google Cast" phrase and/or badges only in accordance with the User Experience Guidelines while your application remains interoperable with Google Cast. Google shall own all right, title and interest, including without limitation all intellectual property rights, relating to the "Google Cast" phrase and/or badges. Except to the limited extent expressly provided herein, Google does not grant you any right, title or interest to any Google brand features, including the "Google Cast" phrase and/or badges.

5.4   All use by Google of your Brand Features (including any goodwill associated therewith) shall inure to your benefit and all use by you of the “Google Cast” phrase or badge (including any goodwill associated therewith) shall inure to the benefit of Google. You shall not challenge or assist others to challenge Google’s Brand Features (except to protect your rights with respect to your own Brand Features) or the registration thereof. You shall not attempt to register any Brand Features or domain names that are confusingly similar to those of Google.

6.   Advertising
6.1   Google may in the future make advertising available via its APIs. Such advertising will appear in connection with your content or service only if you opt in. If Google makes such advertising available, and you choose to serve such advertising, Google may share revenue from that advertising with you pursuant to the advertising terms and conditions made available at the time you opt in to such advertising.

7.   Open Source Software
7.1   As stated in the Google APIs Terms of Service, some of the software required by or included in the Google Cast SDK may be offered under an open source license. There may be provisions in the open source license that expressly override some of these Terms, and in those cases, the overriding provisions apply.

Nutzungsbedingungen
§1 Allgemeines, Begriffsbestimmungen
Die laut.ag bietet im Internet unter anderem unter der Domain „laut.fm“ ein Internetportal in Form eines so genannten „User Generated Radio™“ an, nachfolgend als Dienst bezeichnet. Der Dienst ermöglicht es seinen Mitgliedern unkompliziert und kostenlos eine eigene Radiostation betreiben.
Anbieter des Dienstes ist die laut.ag, Seilerstraße 7, 78467 Konstanz, im Folgenden: Anbieter.
Besucher sind alle Internetnutzer, die den Dienst abrufen. Mitglieder sind die Besucher, die mit dem Anbieter einen Vertrag über die Nutzung des Dienstes geschlossen haben. Nutzer sind sowohl Besucher als auch Mitglieder.
Diese Geschäftsbedingungen gelten für alle gegenwärtigen und zukünftigen Geschäftsbeziehungen. Sie gelten für alle Leistungen im Rahmen des Dienstes.
§2 Leistungsumfang
Der Anbieter bietet eine Vielzahl von Nutzungsmöglichkeiten des Dienstes kostenlos an. Hierzu zählt zunächst die Registrierung innerhalb des Dienstes und des angeschlossenen Forums, aber auch das Anbieten eines eigenen Internetradios selbst. Zusätzlich wird ein Musikpool, sowie eine Upload-Möglichkeit für Musiktitel eingerichtet.
Die zum Betrieb eines solchen eigenen Internetradios erforderlichen und anfallenden Streaminggebühren, GEMA- und GVL-Lizenzen werden durch den Anbieter entrichtet, hierzu wurden entsprechende vertragliche Vereinbarungen mit den entsprechenden Gesellschaften geschlossen, deren wesentlicher Inhalt in § 7 wiedergegeben wird.
Als Gegenleistung wird dem Anbieter die Möglichkeit eingeräumt in den Radiostreams und -Playern Werbung zu schalten.
Der Anbieter übernimmt keine Gewähr dafür, dass die Datenbank des Dienstes Musikstücke enthält, die das Mitglied gerne in seinem Internetradio anbieten möchte. Ebenso übernimmt der Anbieter keine Gewähr für den Erfolg eines Internetradios des Mitglieds.
Eine ständige Verfügbarkeit dieser Dienste kann nicht garantiert werden. Der Anbieter ist ohne vorherige Mitteilung an das Mitglied dazu berechtigt, Dienste endgültig oder vorübergehend zu ändern, zu unterbrechen oder ganz einzustellen.
§3 Teilnahmevoraussetzungen, Vertragsschluss
Die Nutzung des Dienstes ist nur Personen ab 14 Jahren gestattet. Auf Verlangen des Anbieters übermittelt das Mitglied einen ausreichenden Altersnachweis an den Anbieter (z.B. Ausweiskopie).
Das Mitglied verpflichtet sich im Rahmen der Anmeldung zum Dienst dazu, nur wahrheitsgemäße Angaben zu seiner Person zu machen und seine Daten stets aktuell zu halten.
Der Vertrag zwischen dem Anbieter und dem Mitglied über die Nutzung des Dienstes kommt mit der Anmeldung durch das Mitglied zustande. Der Vertrag über die Nutzung von kostenpflichtigen Diensten kommt mit der Bestellung durch das Mitglied zustande.
Die gewählte Laufzeit der Mitgliedschaft beginnt mit der Freischaltung durch den Anbieter.
§4 Kosten der Dienste
Die Registrierung durch das Mitglied ist kostenlos. Der Betrieb eines Basismoduls Internetradio ist ebenfalls kostenlos.
Weitergehende Dienste sind kostenpflichtig. Die Preise richten sich nach einer separaten Preisliste. Alle Preise enthalten die gesetzliche MwSt. von derzeit 19%. Alle Zahlungen sind im Voraus zu entrichten.
Zahlungen können durch Vorkasse, Lastschrift oder per Kreditkarte erbracht werden. Das Mitglied ermächtigt den Anbieter, die von ihm zu leistenden Zahlungen zu Lasten eines vom Mitglied zu benennenden Kontos oder einer Kreditkarte des Mitgliedes einzuziehen. Das Mitglied ist verpflichtet seiner Bank gegenüber die Lastschriftvollmacht mitzuteilen und für eine ausreichende Deckung des Kontos zu sorgen. Die Kosten einer vom Mitglied zu vertretenden Rückbuchung zuzüglich einer weiteren Bearbeitungsgebühr in Höhe von 5 € sind vom Mitglied zu tragen.
§5 Widerrufsbelehrung
Für den Fall, dass ein Nutzer und Mitglied als Verbraucher einen kostenpflichtigen Vertragsbestandteil unter ausschließlicher Verwendung von Fernkommunikationsmitteln abschließt, kann er diese Vertragserklärung innerhalb von zwei Wochen ohne Angabe von Gründen in Textform (z. B. Brief, Fax, E-Mail) widerrufen. Die Frist beginnt frühestens mit Erhalt dieser Belehrung.
Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs oder der Sache. Der Widerruf ist zu richten an den Anbieter, vgl. oben.
Das Widerrufs- und Rückgaberecht erlischt, wenn der Anbieter mit der Ausführung der Dienstleistung mit ausdrücklicher Zustimmung des Verbrauchers vor Ende der Widerrufsfrist begonnen hat oder der Verbraucher diese selbst veranlasst hat
§6 Rechte und Pflichten der Nutzer
Dem Nutzer ist es untersagt, jegliche Art von Pornographie über den Dienst anzubieten, zu überlassen oder zugänglich zu machen (§184 StGB) oder anderweitig gegen Gesetze oder Rechte Dritter (Marken, Namens-, Urheber-, Datenschutz-, Persönlichkeitsrechte usw.) zu verstoßen.
Der Nutzer verpflichtet sich, den Dienst ausschließlich zu privaten Zwecken zu nutzen. Eine gewerbliche Nutzung etwa zu Werbezwecken ist unzulässig.
Die vom Mitglied bereitgestellten Inhalte sind eigene Inhalte des Mitgliedes. Sofern das Mitglied eigene Musikdateien in den Dienst hochlädt, steht es selbst dafür ein, jegliche hierfür erforderliche Rechte zu besitzen.
Der Anbieter stellt das System und den Speicherplatz zur Verfügung. Die Verantwortung für sämtliche Inhalte, die von Mitgliedern über den Dienst des Anbieters übertragen werden trägt ausschließlich das anbietende Mitglied. Der Anbieter ist nicht verpflichtet, die Radiostream und/oder Internetpräsenzen der Mitglieder auf eventuelle Rechtsverstöße zu prüfen.
Stellt der Anbieter fest, dass ein bestimmter Inhalt gegen geltendes Recht verstößt, ist der Anbieter ohne vorherige Ankündigung dazu berechtigt, den fraglichen Inhalt zu unterbrechen oder zu löschen und das betreffende Mitglied zu sperren.
Das Mitglied stellt den Anbieter von Ersatzansprüchen Dritter sowie allen Aufwendungen, die auf einem Verstoß des Mitgliedes gegen die Allgemeinen Geschäftsbedingungen oder die Nutzungsbedingungen beruhen frei.
Der Besucher legt im Rahmen der Anmeldung einen Usernamen und ein Passwort fest, welche Dritten gegenüber geheim zu halten sind. Der Besucher verpflichtet sich, bei Verlust dieser Identifikationsdaten, dies dem Anbieter unverzüglich schriftlich oder telefonisch mitzuteilen. Das Mitglied hat den Anbieter unverzüglich zu informieren, sobald er davon Kenntnis erlangt, dass unbefugten Dritten das Passwort bekannt ist.
Das Mitglied überträgt dem Anbieter ein örtlich zeitlich unbeschränktes Nutzungsrecht an den vom jeweiligen Mitglied auf dem Dienst öffentlich zugänglich gemachten oder gespeicherten Inhalten. Das Mitglied garantiert, dass durch diese Inhalte keine Rechte Dritter verletzt werden.
Die Einbindung von Audiostreams des Anbieters auf Webseiten Dritter ist nicht gestattet. Verlinkungen auf die Audiostreams sind erlaubt, sofern die Verlinkungen dazu führen, dass nach Anklicken der Verlinkungen die Webseiten Dritter verlassen werden und auf laut.fm führen oder alternativ laut.fm nach Anklicken der Verlinkung in einem neuen, separaten Fenster geöffnet wird.
§7 Weitere Vertragspflichten des Mitglieds
Der Anbieter gibt die ihm der Gesellschaft zur Verwendung von Leistungsschutzrechten (GVL) und Gesellschaft für musikalische Aufführungs- und mechanische Vervielfältigungsrechte (GEMA) gegenüber bestehenden Pflichten unmittelbar an das Mitglied weiter. Hierzu gehören insbesondere:

a) Keine Programmvorschau
Das Mitglied darf keine Programmvorschau oder anderweitige Bekanntmachung veröffentlichen oder deren Veröffentlichung veranlassen, in der die Titel der einzelnen Musikaufnahmen oder der Titel eines Albums, in dem die Musikaufnahmen enthalten sind, bekannt gegeben werden, die Inhalt des Programms sind. Außer zu Illustrationszwecken dürfen die Namen der ausübenden Künstler, die im Programm gespielt werden, nicht im voraus genannt werden. Dies schließt die Ankündigung nicht aus, dass ein bestimmter Künstler innerhalb eines nicht näher spezifizierten Zeitrahmens im Programm enthalten ist.

b) Musikprogramm
Das Mitglied darf innerhalb von drei Stunden seines Programms nicht übertragen:

mehr als drei verschiedene Titel von einem bestimmten Album, davon nicht mehr als zwei Titel aufeinanderfolgend; oder
mehr als vier verschiedene Titel eines bestimmten Künstlers oder einer Compilation von Musiktiteln, davon nicht mehr als drei aufeinanderfolgend.
c) Programmwiederholung
Die Übertragung darf nicht Teil eines als solches erkennbaren Programms sein, in dem Musikaufnahmen in einer vorbestimmten Reihenfolge (außer in Archiv-Programmen und Programmschleifen) übertragen werden, wenn dieses Programm übertragen wird:

öfter als drei Mal innerhalb eines im Voraus öffentlich bekannt gegeben Zeitraums von zwei Wochen, sofern es sich um ein Programm von weniger als einer Stunde Dauer handelt; oder
öfter als vier Mal innerhalb eines im Voraus öffentlich bekannt gegebenen Zeitraums von zwei Wochen, sofern es sich um ein Programm von einer Stunde Dauer oder länger handelt.
d) Verbot der Nutzung zu Werbezwecken
Das Mitglied darf die Musikaufnahmen als solche oder als Bestandteil eines Dienstes, der Übertragungen von Bildern oder Filmen anbietet, nicht in einer Weise übertragen, die geeignet ist, den falschen Eindruck einer Verbindung des Urheber- oder Leistungsschutzrechtsinhabers mit dem Mitglied oder einem bestimmten Produkt oder Dienstleistung, die vom Mitglied beworben wird, zu erwecken. Das Mitglied darf ferner bei der Übertragung nicht den Eindruck erwecken, seine über die reine Übertragung von Musikaufnahmen hinausgehenden Tätigkeiten würden durch den Inhaber der Urheber- und/oder Leistungsschutzrechte (einschließlich des ausübenden Künstlers) gesponsort oder anderweitig unterstützt.

e) Keine Übertragung unautorisierter Musikaufnahmen
Das Mitglied darf keine unautorisierten Musikaufnahmen übertragen; dazu zählen ohne Ausnahme sog. Bootlegs (unautorisierte Konzertmitschnitte) und Aufnahmen, die im Land, in dem das Mitglied seinen Sitz hat, noch nicht veröffentlicht worden sind. Das Mitglied darf die Musikaufnahmen nicht re-mixen oder in anderer Weise verändern, sodass die übertragenen Musikaufnahmen sich von den Originalaufnahmen unterscheiden.

f) Bewahren der Integrität von Werken und Darbietungen
Das Mitglied soll beim Gebrauch der Musikaufnahmen die Persönlichkeitsrechte der Urheber und ausübenden Künstler wahren. Er hat insbesondere jede Entstellung oder andere Beeinträchtigung zu unterlassen, die das Ansehen und den Ruf dieser Personen gefährden könnte. Dies gilt gerade auch bei der Verbindung von Musikaufnahmen mit Bildern oder Filmen.

§8 Vertragsbeendigung, Kündigungsfristen
Die kostenlose Mitgliedschaft kann jederzeit gekündigt werden. Die Kündigung hat schriftlich oder durch Löschung seines Profils im Mitgliederbereich zu erfolgen.
Die kostenpflichtige Mitgliedschaft kann von beiden Seiten schriftlich oder online beendet werden. Die schriftliche Kündigung muss per Einschreiben und innerhalb einer Frist von 7 Tagen zum Vertragsende erfolgen. Die Kündigung kann auch unter Einhaltung einer Kündigungsfrist von einem Tag online über den Mitgliedsbereich des Dienstes vorgenommen werden. Wird die kostenpflichtige Mitgliedschaft nicht innerhalb dieser Frist gekündigt, so verlängert sich der Vertrag jeweils um den gleichen Vertragszeitraum der ursprünglich vom Mitglied gewählt worden ist.
Der Vertrag ist durch den Anbieter ohne Wahrung einer Kündigungsfrist außerordentlich kündbar, wenn das Mitglied bei der Anmeldung und/oder späterer Änderung seiner Daten Falschangaben macht, gegen die Allgemeinen Geschäftsbedingungen oder die Nutzungsbedingungen verstößt oder ein sonstiger wichtiger Grund vorliegt. Eine Rückerstattung bereits bezahlter Beträge erfolgt im Fall der außerordentlichen Kündigung nicht.
§9 Haftung
Bei leicht fahrlässigen Pflichtverletzungen beschränkt sich die Haftung des Anbieters auf den nach der Art des Vertrages vorhersehbaren, vertragstypischen, unmittelbaren Durchschnittsschaden. Dies gilt auch bei leicht fahrlässigen Pflichtverletzungen unserer gesetzlichen Vertreter oder Erfüllungsgehilfen.
Gegenüber Unternehmern haften wir bei leicht fahrlässiger Verletzung unwesentlicher Vertragspflichten nicht.
Die vorstehenden Haftungsbeschränkungen betreffen nicht Ansprüche des Kunden aus Produkthaftung. Weiter gelten die Haftungsbeschränkungen nicht bei zugesicherten Eigenschaften und dem Anbieter zurechenbaren Körper- und Gesundheitsschäden oder bei Verlust des Lebens des Kunden.
§10 Datenschutz
Die im Rahmen der Geschäftsabwicklung notwendigen Daten werden mittels einer EDV-Anlage verarbeitet und gespeichert. Persönliche Daten werden selbstverständlich vertraulich behandelt und nicht weitergegeben.
Der Kunde stimmt der Erhebung, Verarbeitung und Nutzung personenbezogener Daten ausdrücklich zu. Ihm steht das Recht auf jederzeitigen Widerruf der Einwilligung mit Wirkung für die Zukunft zu.
Im Übrigen gelten unsere Datenschutzbestimmungen (s.U.).
§11 Änderungen dieser AGB
Der Anbieter hat das Recht, die Bestimmungen bezüglich der zu erbringenden Leistung nach billigem Ermessen in Abwägung der technischen Erfordernisse und Marktgegebenheiten zu ändern, soweit dies für den Kunden zumutbar ist.
Änderungen dieser Allgemeinen Geschäftsbedingungen werden unter im Dienst veröffentlicht. Über Änderungen der AGB, die nicht unter § 10 Absatz 1 fallen wird das Mitglied in Textform informiert. Die Änderungen werden wirksam, sofern der Kunde den jeweiligen Änderungen nicht spätestens 14 Tage nach Zugang der schriftlichen Änderungsmitteilung widerspricht.
§12 Schlussbestimmungen
Es gilt das Recht der Bundesrepublik Deutschland. Die Bestimmungen des UN-Kaufrechts finden keine Anwendung.
Ist der Kunde Kaufmann, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen, ist ausschließlicher Gerichtsstand für alle Streitigkeiten aus diesem Vertrag unser Geschäftssitz, bzw. Düsseldorf. Dasselbe gilt, wenn der Kunde keinen allgemeinen Gerichtsstand in Deutschland hat oder Wohnsitz oder gewöhnlicher Aufenthalt im Zeitpunkt der Klageerhebung nicht bekannt sind.
